Terms of Service

Service Agreement · Last updated: June 1, 2026

These are the terms of the service agreement you enter into with Super Dev Software LLC, operating as MoreCustomersFromTheWeb ("Super Dev," "we," "us"), located at 24310 Moulton Parkway, Suite O-140, Laguna Woods, California 92637, when you sign up for our website service. Before your site goes live you review and electronically sign this agreement — your business details, signature, and the date and time of signing are recorded at that time. The standard terms below are what you agree to.

1. Services Super Dev will provide

Super Dev will design, build, and host a custom website for Customer's business. After payment is received, Customer will be presented with a search tool to choose the domain name for their website. Super Dev will register that domain on Customer's behalf, configure DNS, deploy Customer's site to that domain, and provide ongoing hosting and edits as described below.

The website is a professional small-business website. Super Dev does not guarantee any specific search ranking, lead volume, or business outcome.

2. Fees

Payments are processed via Stripe. Customer authorizes Super Dev to charge the payment method on file for all fees due under this agreement.

3. What's included monthly

Anything beyond 2 edits per month, or any major change (new pages, redesigns, custom features, integrations), is billable at $50 per edit or $75 per hour, billed in advance.

5. Domain and code ownership

Domain name. The domain name is registered in Super Dev's name and is owned by Super Dev during the term of this agreement. Super Dev treats the domain as part of the hosting service, similar to a phone line a service provider supplies.

If Customer cancels and wants to keep the domain:

Website code, design, and structure. All HTML, CSS, JavaScript, design layouts, page structure, image treatments, and other code or design elements that Super Dev creates to build the website are the intellectual property of Super Dev and remain Super Dev's property at all times. Customer is granted only a non-exclusive, non-transferable, non-sublicensable license to use and display the website while it is hosted by Super Dev under this agreement. Customer does not own the code or design and may not copy, download, scrape, mirror, host elsewhere, redistribute, sublicense, sell, reverse-engineer, or otherwise use Super Dev's code or design separately from Super Dev's hosting service. Customer's license to use the website ends when this agreement ends. The only exception is the Section 11 carve-out below: if Super Dev terminates this agreement without cause, Super Dev will provide source files at Customer's request so Customer may host the site elsewhere; outside of that specific scenario, the code and design remain exclusively Super Dev's.

Customer's own content remains Customer's. This section does not affect Customer's ownership of content Customer supplied — Customer's logos, photographs, real reviews, written copy provided in the brief, license numbers, and any other content owned or licensed by Customer remains Customer's property. Super Dev's intellectual-property claim covers only the code, design, structure, and elements Super Dev created to build the website.

6. Customer's content, warranties, and licensing

Customer represents and warrants the following:

  1. Authority. Customer is the legitimate owner of the business named in this agreement, or is fully authorized to act on the business's behalf.
  2. Ownership of content. All photos, text, reviews, business information, services, prices, and other content provided to Super Dev are owned by Customer or properly licensed for use on the website.
  3. No infringement. Content provided does not infringe any trademark, copyright, trade secret, right of publicity, or other intellectual property right of any third party.
  4. Truthfulness. Content is truthful, accurate, and not deceptive. Customer will not provide false reviews, fabricated awards or certifications, false license or insurance numbers, or knowingly misleading information.
  5. No defamation or unfair competition. Content is not defamatory and does not make false or disparaging claims about competitors, including (but not limited to) false price comparisons.
  6. Lawful use. Customer will not use the website for fraud, deceptive practices, illegal activity, or content prohibited by applicable law.
  7. Licensing and qualifications. Customer holds every license, permit, registration, certification, bond, and insurance required by federal, state, and local law to perform every service listed or implied on the website. Customer will not request or approve the listing of any service Customer is not legally authorized to perform.
  8. Notification of changes. If Customer's licensing, certification, bonding, or insurance status changes — including suspension, revocation, expiration, non-renewal, or any disciplinary action by a licensing authority — Customer will notify Super Dev in writing within 7 days and will work with Super Dev to remove or revise any affected content.
  9. Safety and responsibility for work performed. Customer is solely responsible for the safety, quality, legality, and outcome of every service Customer performs for Customer's own customers. The website is advertising; the work is Customer's alone.

Indemnification. Customer agrees to indemnify, defend, and hold Super Dev harmless from any and all claims, lawsuits, demands, investigations, fines, penalties, damages, settlements, attorneys' fees, and costs — whether brought by Customer's customers, end users, neighbors, regulators, employees, competitors, or any other third party — arising from or relating to:

  1. Customer's content or breach of any warranty in this Section 6;
  2. Services Customer performs or fails to perform;
  3. Injury, death, or property damage caused by Customer's work;
  4. Customer's lack of any required license, permit, certification, bond, or insurance;
  5. Any claim that Customer engaged in unlicensed or unauthorized practice of a trade or profession.

This indemnification obligation survives the termination of this agreement.

7. Customer's review and acceptance of the website

Super Dev drafts and fills in content beyond what Customer provides. In building the website, Super Dev will draft, select, source, and add content that goes beyond what Customer originally supplies in the lead intake or brief. This may include — but is not limited to — service descriptions, frequently asked questions, process explanations, hours of operation, neighborhoods and cities listed in the service area, stock photographs and placeholder images, page titles, meta descriptions, structured data and schema markup, and other elements selected to make the website effective. Super Dev adds this content based on Customer's brief, industry norms, publicly available information about Customer's business, and Super Dev's professional judgment. Super Dev does not independently verify the accuracy of any of it.

Customer's pre-payment review is mandatory. Before making the initial $19.99 payment, Customer will review the complete preview website at the preview URL provided by Super Dev — every page, every word, every service description, every claim, every photo, every price, every license or certification number, every hour of operation, every city or neighborhood listed in the service area, every FAQ, and every other detail — including content Super Dev drafted, selected, or filled in beyond what Customer originally provided. Customer's review under this Section 7 is Customer's opportunity, and Customer's responsibility, to identify any inaccurate, incomplete, unauthorized, or unwanted content and to request changes from Super Dev before paying.

Super Dev will make pre-payment corrections at no additional charge. If Customer identifies anything in the preview website that is inaccurate, that Customer is not authorized to publish, or that Customer simply does not want on the site, Customer will notify Super Dev before paying, and Super Dev will revise the preview at no additional charge until Customer is satisfied. Customer is not obligated to pay until Customer has confirmed the preview is accurate and authorized in full.

Payment constitutes adoption. By making the initial $19.99 payment, Customer represents that Customer has reviewed the preview website in full — including every element Super Dev drafted, selected, or filled in — accepts every element of it as Customer's own content and Customer's own representations, and authorizes Super Dev to publish it on Customer's domain. Once Customer has paid, all content on the published website — whether originally supplied by Customer or drafted, selected, or added by Super Dev — is treated as Customer's own content for all purposes of this agreement, including the warranties and indemnification in Section 6. Customer's failure to read or carefully review the preview does not shift responsibility for the content's accuracy or legality to Super Dev.

Post-publication corrections. If after publication Customer discovers any inaccurate, unauthorized, or unwanted content on the website — whether originally supplied by Customer or drafted, selected, or added by Super Dev — Customer will notify Super Dev promptly, and Super Dev will revise or remove the content as part of Customer's monthly edit allowance. Customer's adoption of all published content under this Section 7 remains in effect until any such revision is made.

Future changes. Each future change to the website is subject to the same review and acceptance. Customer's written approval of a proposed change (email or text message is sufficient) constitutes acceptance of the updated content and re-affirms every warranty in Section 6 as applied to the updated content.

8. Super Dev is a vendor only; no verification, no endorsement, no partnership

Super Dev provides website design, hosting, and related technical services only. Super Dev is not Customer's partner, joint venturer, agent, employee, or representative. No agency, partnership, joint venture, franchise, or employer-employee relationship exists between Super Dev and Customer.

Super Dev does not investigate, audit, verify, or endorse Customer's licenses, permits, certifications, insurance, bonds, qualifications, experience, customer reviews, prices, or any other claim Customer makes. Super Dev publishes the content Customer provides and approves. Super Dev has no role in, control over, or responsibility for the trade services Customer performs for Customer's own customers, including the safety, quality, legality, or outcome of that work.

Customer acknowledges that Super Dev is relying on Customer's representations and warranties in this agreement — including the licensing and qualification representations in Section 6 — and that Super Dev would not provide services to Customer without those representations.

9. Customer's insurance

If Customer's trade or services are of a type that customarily requires liability insurance (including but not limited to electrical, plumbing, HVAC, roofing, and general contracting), Customer represents and warrants that they maintain commercial general liability insurance with industry-appropriate coverage limits for the duration of this agreement. Customer's failure to maintain such insurance does not relieve Customer of any obligation under Section 6, including the indemnification of Super Dev.

10. Customer's right to cancel

Customer may cancel this agreement at any time by emailing Super Dev at superdevsoftwarellc@gmail.com. The website remains live through the end of the current paid month, then goes offline. Monthly fees are non-refundable.

11. Super Dev's right to terminate without cause

Super Dev may terminate this agreement at any time, for any reason, including illness, life events, or inability to continue providing services. If Super Dev terminates without cause:

Super Dev may terminate this agreement immediately, without refund and without the 30-day grace period, if Customer:

13. Limitation of liability

To the maximum extent permitted by law, Super Dev's total liability under this agreement, regardless of the cause of action (contract, tort, negligence, or otherwise), is limited to the total amount Customer has paid to Super Dev under this agreement during the twelve (12) months immediately preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot be limited or excluded by applicable law (such as fraud, gross negligence, or willful misconduct).

14. No warranty

The website and services are provided "as is" and "as available." Super Dev does not warrant that the website will be free of errors, will rank in any search engine, will generate any specific number of leads or customers, or will be available 100% of the time. Super Dev will use reasonable efforts to keep the website online and functional.

Super Dev is not responsible for outages caused by third-party services (Cloudflare, Stripe, internet service providers, etc.) outside Super Dev's reasonable control.

15. Governing law, disputes, and attorneys' fees

This agreement is governed by the laws of the State of California, without regard to conflict of law rules. Any disputes will be resolved in the state or federal courts located in Orange County, California, and both parties consent to that jurisdiction.

In any action or proceeding to enforce or interpret this agreement, the prevailing party is entitled to recover its reasonable attorneys' fees and costs, in addition to any other relief awarded.

16. Survival

The following provisions survive termination or expiration of this agreement and remain enforceable: Section 5 (domain and code ownership — Super Dev's intellectual-property rights in the code and design continue beyond termination), Section 6 (content, warranties, licensing, and indemnification), Section 7 (review and acceptance, as to content already published), Section 8 (vendor-only relationship), Section 13 (limitation of liability), Section 14 (no warranty), Section 15 (governing law, venue, and attorneys' fees), and this Section 16.

17. Entire agreement

This document is the entire agreement between Super Dev and Customer regarding the website services. Any prior verbal or written promises not included here are not binding. Changes to this agreement must be in writing and signed by both parties (email confirmation acceptable).

18. Severability

If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.
